Terms of use
Draft for review. A plain-language starting point, not legal advice. Have a lawyer review it before launch, then remove this note.
Effective: [DATE]
These terms are an agreement between you and [LEGAL ENTITY NAME], a Texas limited liability company doing business as Doughcast (“we”, “us”). By downloading or using Doughcast, you agree to them.
What Doughcast is, and isn’t
Doughcast is a planning tool. It projects future balances from the information you enter. Those projections are estimates: they’re only as accurate as the information behind them, and real life (late paychecks, bank holds, surprise bills) can differ. Doughcast is not financial, tax, legal or investment advice, and it isn’t a bank or a record of your actual account balances. Decisions about your money are yours.
Free trial and subscriptions
- New customers can try Doughcast free for [TRIAL LENGTH] days.
- Subscriptions renew automatically, monthly or yearly, at the price shown when you subscribe, until you cancel. We’ll tell you in advance before changing the price of an existing subscription.
- You can cancel at any time. You keep access until the end of the period you’ve paid for.
- A founding-member purchase is a one-time payment for access for the life of the product, as described when you buy it.
- Prices don’t include taxes; applicable sales tax or VAT is added at checkout.
- Refunds are covered by our refund policy.
If your subscription ends
If your subscription ends, Doughcast may switch to read-only mode. Your plan stays on your device, and you’ll still be able to view it and take it with you.
Your data and your password
Your plan is stored on your device and encrypted with your password. We don’t have your password and can’t recover it or your plan if it’s lost. You’re responsible for keeping your password safe and for making backups.
License
While your subscription or purchase is active, we grant you a personal, non-transferable license to use Doughcast on devices you own or control, for your own and your household’s use. Please don’t resell it, reverse-engineer it except where the law allows, or use it to break the law.
Updates and changes
We improve Doughcast over time and may add, change or remove features. If we change these terms in a way that matters, we’ll tell you before the change takes effect.
Warranty disclaimer
Doughcast is provided “as is”. To the extent the law allows, we disclaim all warranties, including that it will be error-free or that its projections will be accurate.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect or consequential losses, such as overdraft fees, late fees or lost profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Ending these terms
You can stop using Doughcast at any time. We may suspend or end access if you seriously breach these terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. [DISPUTE RESOLUTION AND VENUE: TO BE DECIDED WITH YOUR LAWYER.]
